Spain fast-tracks the preparation of its Aliens Act reform
On 22 September 2026 Spain's Council of Ministers authorised urgent administrative processing for the draft reform of Organic Law 4/2000 on the rights of foreigners and for the new Asylum Law. The drafts align Spanish rules with the EU Pact on Migration and Asylum.

What happened
The official summary (Referencia) of the Spanish government's meeting of 22 September 2026 lists two agreements among the Interior items. One authorises urgent administrative processing of the draft Organic Law ("Anteproyecto de Ley Orgánica") amending Organic Law 4/2000; the other does the same for the draft Asylum Law ("Anteproyecto de Ley de Asilo"). At the same meeting the government also received an updated report on the situation in Ceuta.
According to eldiario.es on 25 August 2026, the government first approved the two drafts that day to align Spanish law with the EU Pact on Migration and Asylum, which entered into force in June 2026. The paper reports that the Aliens Act draft introduces screening ("triaje") of foreigners crossing the border: information gathering, a medical examination, a vulnerability assessment, biometric data collection and a security check. The time limit is 72 hours, extendable only by a court in justified cases – stricter than the seven days allowed under EU rules. The draft also contains a border return procedure.
