Hungarian immigration authority: refusals of consulate applications are served by public notice, and the appeal deadline runs from then

On 28 September 2026 Hungary's National Directorate-General for Aliens Policing (OIF) published a notice for applicants who file at a consulate. If the authority refuses an application or terminates the procedure, it serves the decision by public notice, and the appeal deadline runs from that service.

Background

What happened

According to the OIF notice, if the authority refuses an application filed at a consulate for issuing, replacing or exchanging a residence permit, or for extending a national settlement permit issued in the national economic interest, or terminates the procedure, it serves the decision by public notice, because postal delivery to a foreign address cannot be tracked.

When sending the decision, the authority also notifies the consulate, which informs the applicant that a decision has been served by public notice. The appeal deadline, however, runs from the date of service by public notice. That date is the 15th day after publication on the website; in residence permit cases an appeal may be filed within 8 days of service, and within 15 days where an extension of the national settlement permit is refused. The decision is also served on the authorised representative or legal representative. The OIF asks applicants to check the public notices regularly.
